This article examines a fatwa issued regarding the issue of sex selection via In Vitro Fertilization (IVF) and Pre-implantation Genetic Diagnosis (PGD). Through the critical examination of conditional permission by the fatwa based on principles of Sharia, including the sanctity of the marriage bond, reliance on the will of Allah, avoidance of harm to mothers, and the prohibition of the applications of homosexuals, it is hoped that this study would pinpoint the possibility of the fatwa in informing whatever may be national regulations regarding Assisted Reproductive Technologies (ARTs). A comparative policy analysis based on ART guidelines formulated in Malaysia and Saudi Arabia using their fatwas is utilized to propose a model of integrated policy in accordance with the Sharia laws particular to Bangladesh. The proposed model aims to guarantee equitable access to these technologies, together with correcting regulatory deficiencies and curbing the chances for misuse. Moreover, the findings highlight the need for interdisciplinary cooperation between Islamic scholars (Ulama) and policymakers in regard to the ethics of new reproductive technologies.
সারসংক্ষেপ : এই প্রবন্ধে ইনভিট্রো ফার্টিলাইজেশন (IVF)এবং প্রি-ইমপ্লান্টেশন জেনেটিক ডায়াগনোসিস (PGD).-এর মাধ্যমে শিশুর লিঙ্গ নির্বাচন সংক্রান্ত বিষয়ে একটি ফাতওয়াকে বিশ্লেষণ করা হয়েছে। বৈবাহিক সম্পর্কের বাধ্যবাধকতা, আল্লাহর ইচ্ছার উপর নির্ভরতা, মায়ের ক্ষতি এড়ানো এবং সমকামী প্রয়োগ নিষিদ্ধ ইত্যাদি শরিয়া নীতির উপর ভিত্তি করে প্রদত্ত ফাতওয়ার শর্তসাপেক্ষ অনুমতি বিশ্লেষণ করার মাধ্যমে এই গবেষণাটি অনুসন্ধান করে যে, কীভাবে এই ফাতওয়া সহায়ক প্রজনন প্রযুক্তির (অজঞং) জন্য একটি জাতীয় রেগুলেশন তৈরিতে সহায়ক হতে পারে। মালয়েশিয়া এবং সৌদি আরবে এ সংক্রান্ত ফাতওয়ার উপর ভিত্তি করে এআরটি নির্দেশিকা তৈরি করা হয়েছে তাদের তুলনামূলক নীতি বিশ্লেষণ করার মাধ্যমে এই নিবন্ধে বাংলাদেশের জন্য একটি শরিয়া-সমন্বিত নীতি মডেল প্রস্তাব করা হয়েছে। যে মডেল এ প্রযুক্তির ন্যায়সঙ্গত ব্যবহার নিশ্চিত করতে পারবে, একই সাথে নিয়ন্ত্রন সংক্রান্ত ত্রুটি পূরণ করতে ও অপব্যবহার রোধ করতে ভূমিকা পালন করবে। তাছাড়া, এই গবেষণা থেকে প্রাপ্ত ফলাফল উদীয়মান প্রযুক্তিগুলোকে সঠিক ও নীতিগতভাবে নিয়ন্ত্রণ করার জন্য আলেম সমাজ এবং নীতিনির্ধারকদের মধ্যে আন্তঃসহযোগিতার প্রয়োজনীয়তার গুরুত্বকে সুস্পষ্ট করে।
