Abstract

The distinctive and the preeminent feature of the Islamic ideology is its law of Inheritance. Every minute detail is mentioned in this law, including how we are to lead our life with all the necessities throughout our life span and even after death, how property is to be distributed to the deserving ones and looked after, so no issue occurs. Of course, the law made by Islam is the most scientific and logical, since every thing is under the supervision of the Almighty Allah, Who is aware not only of the present but also of the future, the unseen- this law is made by Him. In this article, the only motive that has been indicated is respect and lineage of the women in society. Not only that she should not be deceived, but the relationship between men and women, and their needs, have been given the highest priority from the view point of Al-Qur'an, As-Sunnah and the legal documents of the modern Islamic law. Side by side, the security of the women is also mentioned here. It has also been proven that the women have been given the highest part of property in the law of Inheritance. It is to be noted that the method of description and comparative study of the topic mentioned has been analyzed in this text.

সারসংক্ষেপ: ইসলামী জীবন বিধানের বিশেষ বৈশিষ্ট্য ও অপার সৌন্দর্য হলো এর উত্তরাধিকার আইন। এ আইনে মহান আল্লাহ মানুষের জীবদ্দশায় তার সকল প্রয়োজনের কথা যেমনিভাবে বিবেচনায় রেখেছেন, তেমনি তার মৃত্যুর পরও রেখে যাওয়া সম্পদ নিয়ে যেন কোনো বিশৃংখলা সৃষ্টি না হয় এবং প্রকৃত প্রাপকেরা যেন এর উত্তরাধিকারী হতে পারে সে লক্ষ্যে সুস্পষ্ট বিধান প্রবর্তন করেছেন। উত্তরাধিকারের ব্যাপারে ইসলামের বিধান নিঃসন্দেহে বিজ্ঞানসম্মত ও যৌক্তিক। কারণ এ বিধান বিশ্বজাহানের ঐ মহান স্রষ্টা কর্তৃক প্রণীত, যিনি মানুষের বর্তমান ভবিষ্যত সকল কিছুর স্রষ্টা। প্রবন্ধটিতে আল-কুরআন, আস্সুন্নাহ ও আধুনিক ইসলামী সাহিত্যের দালিলিক ও যৌক্তিক উপস্থাপনার ভিত্তিতে একথা প্রমাণের প্রয়াস চালানো হয়েছে যে, ইসলামী জীবন বিধানে মহিলাদেরকে কিংবা অন্য কাউকেই বঞ্চিতের তো প্রশ্নই আসে না; বরং নারী ও পুরুষ উভয়ের বেলায়ই তার প্রয়োজন ও চাহিদা এবং তার সাথে সম্পৃক্ত অন্যদের প্রয়োজন ও চাহিদাকেই সর্বোচ্চ গুরুত্ব প্রদান করা হয়েছে। সেই সাথে একজন নারীর আপদকালীন নিরাপত্তার কথাকেও বিশেষ গুরুত্ব প্রদান করা হয়েছে। প্রবন্ধটিতে আরো প্রমাণ করা হয়েছে যে, সার্বিক বিবেচনায় ইসলামের উত্তরাধিকার আইনে একজন পুরুষকে নয়, বরং একজন নারীকেই অধিক অংশ দেয়া হয়েছে। প্রবন্ধটি প্রস্তুত করার ক্ষেত্রে বর্ণনা, বিশ্লেষণ ও তুলনামূলক পদ্ধতি অনুসরণ করা হয়েছে।]
